Terms of Use

Operator: RepairHVACnow (“RepairHVACnow”, “we”, “our”, or “us”)

These Terms of Use (“Terms”) govern your access to and use of the Site and any related pages, content, features, or tools we make available (collectively, the “Service”). By visiting or using the Service in any way, including browsing, requesting HVAC service or any service ancillary thereto, submitting a form, or creating an account, you (“you” or “user”) agree to these Terms and to our Privacy Policy located at https://www.repairhvacnow.com/privacy-policy, which is incorporated by reference.

If you do not agree to these Terms, do not use the Service.

Marketplace Role

RepairHVACnow operates a lead-generation and marketplace platform that connects users seeking HVAC, plumbing, and related home services with independent third parties or with larger service organizations that may, in turn, assign those requests to their own technicians, affiliates, franchisees, or contractors (collectively, “Service Providers”). RepairHVACnow does not itself provide HVAC services and is not a licensed contractor. We do not employ, supervise, or control the Service Providers, and we are not a party to any agreement between users and any Service Provider or organization that accepts a referral from us. Any HVAC or related work is performed solely by the selected Service Provider or its designee, under terms arranged directly between that provider (or organization) and the user. In some cases, RepairHVACnow may share your service request with a partner network or affiliated company that coordinates with multiple technicians or franchise locations. Those entities, and not RepairHVACnow, determine which technician or team performs the work.

1. Eligibility & Your Agreement

1.1 By using the Service, you represent and warrant that you:

  • have read and understood these Terms and have the legal capacity to agree to them;
  • are at least the age of majority in your jurisdiction;
  • have authority to bind any organization you use the Service for; and
  • if you request work at a property, you own the property or have authority from the owner/manager to authorize the requested HVAC service or any service ancillary thereto.

1.2 A printed version of these Terms is admissible in judicial or administrative proceedings to the same extent as other business records kept in printed form.

1.3 We may modify these Terms at any time. If we make material changes, we’ll post the revised version on the Site and, where appropriate, provide notice (e.g., email or in-Service message). Your continued use of the Service after the effective date of changes constitutes acceptance of the updated Terms.

1.4 These Terms apply whether you access the Service through our website, a partner landing page, or an affiliated marketing campaign.

2. Using the Service

2.1 The Service allows homeowners, property managers, and businesses to learn about HVAC repair, maintenance, installation, and replacement and to request appointments. To submit a request, you may need to provide contact details, location, and a description of the issue or project.

2.2 Any estimates, availability windows, or timelines shared through the Service are informational and may change based on scope, parts availability, property access, and technician assessment. You are responsible for providing accurate, up-to-date information and ensuring safe access to the work area.

2.3 Listings, matches, or referrals do not constitute endorsements. We do not guarantee that a Service Provider will accept a job, offer a particular price, arrive at a specific time, hold particular licenses/insurance, obtain permits, or deliver any outcome.

2.4 Any pricing or cost information displayed on the Service is for general informational purposes only. Actual rates are determined solely between users and Service Providers. RepairHVACnow does not collect payments, hold funds, or facilitate transactions between users and Service Providers.

2.5 We may, in our discretion, conduct limited checks (e.g., license or insurance verifications) based on self-reported or public data. Such checks can be incomplete or outdated. We do not guarantee that any verification process is ongoing, comprehensive, or error-free. Users remain solely responsible for verifying any Service Provider’s qualifications and suitability. 

3. Accounts, Accuracy & Conduct

3.1 If you create an account, you agree to keep your credentials confidential, maintain accurate information, and promptly update any changes (e.g., phone number or address). You are responsible for all activities under your account.

3.2 You agree not to use the Service:

  • for any unlawful purpose;
  • to submit false, misleading, or incomplete information;
  • to interfere with or disrupt the Service or our security measures;
  • to copy, scrape, mirror, or harvest data from the Service without written permission;
  • to transmit malware, spam, or other harmful code;
  • to attempt to gain unauthorized access to our systems or data; or
  • to use the Service in any way that could interfere with or burden its normal operation, such as automated form submissions or high-volume queries.

3.3 We may suspend or terminate access for violations of these Terms.

4. Intellectual Property & Limited License

4.1 Except for your User Content (defined below), the Service and all materials on it, including text, graphics, photos, video, icons, logos, designs, interfaces, compilations, and software (collectively, “Content”), are owned by or licensed to RepairHVACnow and are protected by intellectual property and other laws.

4.2 Subject to your compliance with these Terms, we grant you a limited, terminable at our sole discretion without notice,, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial purposes (or internal business purposes if you represent a business customer). We reserve all rights not expressly granted.

4.3 You may not: 

  • copy, modify, or create derivative works of the Service; 
  • reverse engineer or decompile any part of the Service except as permitted by law;
  • remove or alter proprietary notices; or
  • use any robot, spider, or automated means to access or extract data from the Service without written permission.

5. User Content & Feedback

5.1 You may submit content to us (e.g., messages, reviews, photos, project details, feedback, or other materials) (“User Content”). If you submit User Content, you represent and warrant that you own it or have all necessary rights to grant the license below and that it does not contain malware, violate law, or infringe any third-party rights.

5.2 You grant RepairHVACnow a worldwide, royalty-free, transferable, sublicensable, irrevocable, and perpetual license to host, store, reproduce, adapt, publish, translate, distribute, and display your User Content in any media for the limited purposes of operating, improving, marketing, and providing the Service. We have no obligation to use or retain User Content and may remove it at any time.

5.3 Do not submit personal data of others without permission. If your User Content contains images or information about other people, you are responsible for obtaining all necessary consents.

5.4 RepairHVACnow does not sell personal information included in User Content as defined under applicable privacy laws.

6. Prohibited Activities

6.1 Without limiting anything above, you must not:

  • post pornographic, obscene, hateful, harassing, or defamatory content;
  • promote illegal activity or violence;
  • run contests, promotions, or advertisements via the Service without written approval;
  • overload the Service with unreasonable traffic or requests;
  • probe, scan, or test vulnerabilities of the Service or related networks;
  • collect users’ personal data without consent; or
  • to misrepresent your affiliation with any HVAC provider or impersonate another business.

6.2 We may, but are not obligated to, monitor or moderate content on the Service.

7. No Warranties

7.1 THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY LAW, REPAIRHVACNOW DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

7.2 Any third-party information (including manufacturer documentation, product specs, or external links) is provided for convenience only. We are not responsible for its accuracy or availability.

7.3 HVAC services are performed exclusively by Service Providers. To the fullest extent permitted by law, we make no warranties regarding Service Providers’ workmanship, code compliance, permits, availability, pricing, or results.

7.4 We do not guarantee that a Service Provider will be available in your area.

8. Limitation of Liability

8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL REPAIRHVACNOW OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF USE; LOSS OF DATA; LOSS OF PROFITS; COST OF COVER; OR ANY OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8.2 TO THE EXTENT ANY LIABILITY IS FOUND DESPITE THE ABOVE, OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO REPAIRHVACNOW (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, THE ABOVE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

8.3 Nothing in this Section limits liability for personal injury caused by our willful misconduct except where such limitation is prohibited by applicable law.

9. Indemnification

9.1 You agree to defend, indemnify, and hold harmless RepairHVACnow and its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: 

  • your use or misuse of the Service;
  • your breach of these Terms or applicable law;
  • your User Content; or
  • your interactions related to HVAC service or your interactions related to HVAC or other services at your property.

9.2 We may control the defense of any matter subject to indemnification by you, and you will cooperate fully with our defense.

10. Text Messages (SMS/MMS)

10.1 Consent to Receive Communications

  • By providing your mobile number, you consent to receive SMS and MMS messages from RepairHVACnow, which may include service updates, appointment scheduling notices, limited promotions, and important account or Service-related communications.
  • Message frequency may vary by user activity and appointment status, but will generally not exceed four (4) messages per month. Message and data rates may apply.
  • To the extent permitted by law, we may use automated technology, including autodialers and prerecorded messages, to deliver such communications. Consent is not a condition of purchase or use of the Service.

10.2 Opt-Out & Help Information

  • To opt out, text STOP to (332) 244 6449. You may receive one final confirmation message to verify your opt-out.

10.3 Carrier & Delivery Disclaimers

Participating carriers may include, but are not limited to, AT&T, T-Mobile®, Verizon, Sprint, Boost, U.S. Cellular®, MetroPCS®, Cricket, and others. Carriers are not liable for delayed or undelivered messages.

10.4 Data Collected

Data collected in connection with this messaging program may include your phone number, carrier name, message content, and timestamps. This information may be used to operate, improve, and manage message delivery and scheduling.

11. Electronic Communications

By using the Service, you consent to receive emails and other electronic communications from us about your requests, your account, and updates to the Service or these Terms. You may opt out of promotional emails at any time by following the unsubscribe instructions in the message. You will still receive transactional or service-related emails.

12. Third-Party Websites, Tools, & Content

The Service may link to third-party sites, tools, or services we do not control. Different terms and privacy policies may apply to your use of those resources. We are not responsible for third-party content, availability, or practices, and you use them at your own risk. Some third-party links may be affiliate or sponsored placements, for which RepairHVACnow may receive compensation.

13. Dispute Resolution | Arbitration | Class Waiver

Please read this section carefully as it affects your legal rights.

13.1 To resolve most issues quickly, contact us first at support@repairhvacnow.com. If a dispute is not resolved within 30 days, either party may elect binding arbitration as the sole method of dispute resolution (except for small-claims or certain IP matters as noted below). 

  • Rules & Forum
    Arbitration will be administered by the American Arbitration Association (AAA) under the Consumer Arbitration Rules. A single arbitrator will preside.
  • Location & Law
    Unless we agree otherwise, the arbitration will be conducted in Wilmington, Delaware, or by video/telephone for convenience, and governed by Delaware law, with the Federal Arbitration Act (“FAA”) governing the interpretation and enforcement of this Section.
  • Fees & Award
    Each party bears its own costs and an equal share of administrative fees, subject to the AAA rules. The arbitrator’s award shall be final and may be entered in any court of competent jurisdiction.
  • Class Action Waiver
    Arbitration will proceed only on an individual basis. No class, consolidated, or representative actions are permitted.
  • Exceptions
    Either party may bring a claim in small-claims court (if eligible) or seek injunctive relief for intellectual-property matters in a court of competent jurisdiction.
  • Opt-Out
    You may opt out of arbitration within 30 days of your first use of the Service by emailing sales@repairhvacnow.com with the subject line “ARBITRATION OPT-OUT” and your full name and address.
  • Confidentiality
    All arbitration proceedings and awards will be confidential except as required by law.

If the class-action waiver is found unenforceable, this arbitration provision will be void as to that dispute, and the dispute will proceed in court.

15. Miscellaneous

15.1 Entire Agreement 

These Terms, together with our Privacy Policy and any additional posted terms (e.g., offer details or service-specific terms), are the entire agreement between you and RepairHVACnow regarding the Service.

15.2 Assignment

We may assign these Terms at any time. You may not assign them without our prior written consent.

15.3 Severability

If any provision is unenforceable, the remaining provisions will remain in full force and effect.

15.4 No Waiver

Our failure to enforce any right is not a waiver of future enforcement.

15.5 Governing Law

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law.

15.6 Headings

Headings are for convenience only and do not affect interpretation.

15.7 Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control, including weather emergencies, acts of government, supply-chain disruptions, labor issues, utility outages, or network/platform interruptions.

15.8 Survival

Sections 4 – 9, 11 – 15, the arbitration clause in Section 13 and any provisions which by their nature should survive, will survive termination.
