1. Who We Are

1.1:  RepairHVACnow operates an online lead-generation and marketplace platform that connects users with independent, third-party HVAC providers and, in some cases, larger service organizations that may route your request to their own technicians, affiliates, franchisees, or contractors (“Service Providers”). We respect your privacy and want you to understand what personal information we collect, how we use it, with whom we share it, and the choices available to you.

1.2:  This Privacy Policy applies to information that identifies or can reasonably be linked to you (“Personal Information”) collected on the Site and in related online interactions, as well as limited offline collection (e.g., phone support). By accessing or using the Site, you acknowledge this Policy and our Terms of Use.

1.3:  If you do not agree with this Policy, please do not use the Site or provide us with Personal Information.

1.4: We may update this Policy from time to time. If we make material changes, we’ll post the updated Policy on this page and, where appropriate, notify registered users (e.g., email or in-Site notice). Your continued use of the Site after the effective date constitutes acceptance of the updated Policy.

2. California “Notice at Collection” (CPRA)

2.1:  At or before the point of collection, California residents are entitled to know what we collect, why, whether we “sell” or “share” it (as defined by CPRA), the retention schedule/criteria, and how to exercise rights.

2.2 Categories collected:

  5. Professional/business info (for Service Providers): company name, license/insurance details, service areas
  6. Inferences: basic audience segments derived from analytics/ads (e.g., interest in HVAC services)

2.3 Purposes of use: provide and operate the Site; match and route requests; communicate (email/SMS); security/fraud prevention; personalization/analytics; marketing/remarketing; compliance/legal.

2.4 Disclosures for a business purpose: to our vendors (hosting, analytics, communications, security), to Service Providers (for routing your request), and as described in this Policy.

2.5 Sale/Share: We do not sell Personal Information for money. We may “share” Personal Information for cross-context behavioral advertising within the meaning of CPRA. To opt-out, email at sales@repairhvacnow.com, with the subject “OPT OUT”.

2.6 Retention: We retain Personal Information only as long as reasonably necessary for the purposes described above, including to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. Retention periods vary by category and context. When determining retention, we consider the nature of the data, the purpose of processing, legal requirements, and security needs. When data is no longer needed, we delete, de-identify, or aggregate it.

3. Information We Collect

3.1 We collect Personal Information (1) directly from you, (2) automatically through cookies and similar technologies, and (3) from public sources and third parties (in compliance with applicable law). We collect only what is adequate, relevant, and reasonably necessary for the purposes described below.

3.2.1: You typically provide this information when you: submit a service request; sign up for updates; create/manage an account; communicate with us; complete forms, surveys, or promotions.

3.3 Information Collected Automatically (“Automated Information”)

  1. IP address and general location (e.g., city/region)
  2. Device and browser characteristics, operating system, language settings
  3. Referring/exit pages, pages viewed, links clicked, time/date stamps
  4. Session data, error logs, performance metrics
  5. Cookie identifiers, pixel tags, and similar technologies

3.3.1: You can control some cookie settings via your browser; some features may not work without them.

3.4 Information from Third Parties and Public Sources

3.4.1: We may receive Personal Information from marketing partners, ad/analytics networks, public sources (e.g., business/license portals), and Service Providers (e.g., limited status updates). Third parties may also collect information via the Site using cookies, pixels, and SDKs to provide analytics, measure ad effectiveness, and deliver interest-based ads.

4.1: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Targeted Advertising & Remarketing

5.1:  We work with advertising and analytics partners to deliver interest-based ads and measure effectiveness. Partners may collect data about your online activity across sites/apps via cookies, pixels, and similar tech.

6.1: We use analytics and diagnostic tools to understand Site traffic, improve performance, and measure marketing effectiveness. These may collect anonymized information such as IP address, device type, pages visited, and interactions.

  4. Business transfers: merger, acquisition, financing, restructuring, bankruptcy, sale of assets
  5. With your consent or at your direction

7.1 De-identified/Aggregated Data

We may create, use, and share de-identified, anonymized, or aggregated data (which cannot reasonably identify you) for analytics, research, and business purposes. We will not attempt to re-identify such data except as permitted by law.

8. Your Privacy Choices

9. SMS (Text Messages)

9.1:  If you provide your mobile number and consent, we may send SMS/MMS about service updates, scheduling, limited promotions, and important account/Service info. 9.2: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with third parties.

10. Security

We use commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Information. No method of transmission or storage is 100% secure. Any transmission is at your own risk. We are not responsible for unauthorized circumvention of privacy or security measures.

11. Children

The Site is not intended for individuals under 16. We do not knowingly collect Personal Information from anyone under 16. If we learn we have collected such information without appropriate consent, we will delete it.

12. Confidential or Proprietary Submissions

Do not send confidential or proprietary information to us through the Site or email. Submissions (ideas, feedback, suggestions) are deemed non-confidential; by submitting them you grant us a right to use them without compensation, consistent with applicable law. We will not publicly attribute your name without permission or legal requirement.

13. Data Retention

We retain Personal Information for as long as reasonably necessary to accomplish the purposes described in this Policy, including to provide the Service, comply with legal obligations, resolve disputes, and enforce agreements. 14. State Privacy Rights (U.S.)

14.1 U.S. state privacy laws (e.g., California CPRA, Colorado CPA, Connecticut, Virginia VCDPA, Utah, Texas, Oregon, and others) may grant residents certain rights, which generally include the right to:

  1. access/know categories and specific pieces of Personal Information we have about you;
  2. request deletion (subject to legal exceptions);
  3. correct inaccuracies;
  4. opt out of “sale,” sharing, or targeted advertising;
  5. opt out of certain profiling for decisions producing legal or similarly significant effects; and
  6. receive non-discriminatory treatment for exercising these rights.

14.1.2:  To protect your information, we will take reasonable steps to verify your identity (e.g., by matching email/phone on record). You may use an authorized agent where permitted by law; we may require proof of authorization and your verification.

14.1.3: We will confirm receipt within 10 business days and respond within 45 days (or notify you of a permitted extension, up to 90 days total). Where available, data portability responses will be provided in a commonly used, machine-readable format.

14.2 Virginia (VCDPA) | Appeal Process

If we decline to act on your request, you may appeal within 30 days of our decision by emailing sales@repairhvacnow.com with the subject line “VCDPA Appeal” and an explanation. We will respond to your appeal within 60 days. If we deny your appeal, we will provide you with a method to contact the Virginia Attorney General to submit a complaint.

14.3 Colorado / Connecticut / Oregon | Appeals & Universal Opt-Out

14.3.1: We provide a similar appeal process for Colorado, Connecticut, and Oregon. Email sales@repairhvacnow.com with subject “State Privacy Appeal” and your state of residence.

14.3.2: Where required (e.g., Colorado), we recognize approved Universal Opt-Out Mechanisms (UOOM), including recognized browser/device signals like Global Privacy Control (GPC), to opt out of “sale,” “sharing,” or targeted advertising to the extent required by law.

14.4 Sensitive Data (where applicable)

We do not seek to collect sensitive data (e.g., precise geolocation beyond IP-based region, health information, government IDs). If processing of sensitive data becomes necessary, we will obtain opt-in consent where required by law.

15. Colorado Data Protection Assessments (CPA)

For processing activities that present a heightened risk of harm, including targeted advertising, certain profiling, or activities that may be deemed a “sale” or “sharing” of Personal Information, we conduct Data Protection Assessments as required by Colorado law and maintain documentation of these assessments.

16. Third-Party Websites & Apps

The Site may contain links to third-party sites or apps. We are not responsible for their privacy practices or content. If you use third-party sites or apps to access our Site, your activities there are governed by those parties’ policies.

17. Governing Law

This Policy and any disputes relating to it are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law principles. (Dispute resolution terms are set forth in our Terms of Use.)
